Clearwater County Sheriff

The Clearwater County Sheriff's Office handles law enforcement for the county and manages the county jail. When an arrest is made, the Sheriff's Office creates the arrest record. That document then goes to the county attorney's office for review. Very recent arrests may not yet appear in MCRO. The time between an arrest and formal charging can vary by several days or more. Expungement in Clearwater County

Minnesota law gives people with qualifying criminal records the option to petition to have them sealed under Minn. Stat. Chapter 609A. Minnesota's Clean Slate provisions at Minn. Stat. Section 609A.015 automatically seal certain low-level offenses without a petition being required. Cases that qualify under that law are sealed without any action from the person whose record is involved.

For cases not covered by automatic sealing, a petition must be filed with the Clearwater County District Court in Bagley. Waiting periods depend on the type of offense and how the case ended, ranging from one to five years. Cases that ended without a conviction may qualify sooner than those with a guilty plea or verdict. Filing fees are required but can be waived based on income.
