Benton County borders Sherburne County to the south, one of the fastest-growing counties in Minnesota. Benton itself has seen population increases over the past decade. The court handles a wide range of criminal cases, from minor traffic violations to felony filings. All public criminal cases filed in district court are searchable through MCRO.

The statewide MCRO system also covers case records from the Minnesota Courts access page. You can find more details there about what the system covers and how to use it.

Restricted records do not appear in MCRO searches. Juvenile cases, sealed filings, and cases under expungement orders are hidden from public view as required by Minnesota law. If a case is sealed, no results will show, even if the case does exist. A blank result is not always proof that no record is there.

Note: Court calendars for Benton County post at 7:00 AM daily and update hourly. Hearing times and dates can change. Check the calendar online before traveling to Foley to confirm your hearing is still scheduled.

The Minnesota Bureau of Criminal Apprehension runs a statewide conviction database at dps.mn.gov. Each search costs $8. You need the person's full name and date of birth to run a search. Results show conviction records from all 87 Minnesota counties for the past 15 years. Benton County convictions are included in those results.

BCA results show convictions only. Pending cases, dismissed charges, and acquittals are not listed there. For complete case information, including current case status and non-conviction entries, use MCRO. Think of BCA as a broad statewide conviction check, and MCRO as the tool for detailed case records.

Benton County Sheriff

The Benton County Sheriff's Office handles law enforcement across the county. Arrest records and jail booking data are maintained separately from the district court system. The sheriff's office page is at co.benton.mn.us. The county government website is at co.benton.mn.us.

An arrest or booking record does not confirm that court charges were filed. After reviewing a sheriff's record, search MCRO to check whether a criminal case was formally opened in district court. The two systems are separate and one does not automatically update the other.

Minnesota Government Data Practices Act

Criminal court records in Benton County are governed by Minn. Stat. Chapter 13, the Minnesota Government Data Practices Act. Some records are classified as not public under Chapter 13. Juvenile case files are generally confidential. Records sealed by court order are not open to the public. Victims' addresses and other protected information may be redacted from documents even when the case itself is public. The full text of Minn. Stat. Chapter 13 is available on the Minnesota Legislature website if you need to understand what applies to a specific record type.
